This privacy statement informs you about our purpose for collecting, processing and using personal data (type, scope). With this privacy statement we also inform data subjects about the rights granted to them. This privacy statement applies exclusively to www.adeqat.com and related subpages, and not for websites controlled and operated by third parties.
[1.] Data security
[1.1] To protect your data, ADEQAT has taken appropriate technical and organisational measures. These measures protect your data against loss, manipulation and unauthorised access. The measures taken are subject to regular review and are continuously brought up to the current state of art.
[1.2] Please note that you are responsible for the safekeeping and privacy of any user data and/or passwords you have been supplied with.
[2.] Use by minors
It should be noted that the www.adeqat.com website may only be used by people who have reached the age of 14. Nevertheless, should data of minors have been processed, we will stop processing the data as soon as we have been informed thereof.
[3.] Collection and processing of personal data
[3.1] Personal data provided by you
Personal data are only processed by us in accordance with legal provisions for privacy protection. When communicating with us or filling out a data form on our website please note that the data you specify on the form will be processed for the purposes described below (see sections 5 and 6).
[3.2.] Data collected by us
For the purpose of personal data processing, ADEQAT also makes use of subcontractors who work on behalf of ADEQAT in accordance with Art. 28 of the General Data Protection Regulation (GDPR). These partners are chosen carefully, and, with the help of appropriate technical and organisational measures, they ensure that the processing of your data is in accordance with privacy protection requirements and that the protection of your rights is guaranteed. The partners are not permitted to use the data for their own purposes (such as advertising) or to disclose the data to third parties.
All contracting parties have committed themselves in writing to secrecy and confidentiality of all personal data provided. Furthermore, ADEQAT will not disclose any information to third parties – such as address publishers and direct mail companies.

General contact form
Contact form to contact ADEQAT for a call-back, a request to be contacted by ADEQAT, appointments, praise or criticism, questions of all kinds and other issues. When submitting your contact form, specific categories of your personal data (contact and identification data, text of your request) will be processed and transmitted for further handling to the employee responsible at ADEQAT.
Purpose: timely response to your request in accordance with the commitment of so doing within 24 hours or the next business day, and if necessary, contacting you personally.
Justification: Legitimate interest in processing your questions individually and providing a reliable answer.
Storage period: see section 7
*Data fields: title, first name, last name, desired type of contact by ADEQAT (call-back, email), depending on the form of contact: phone number or email address; information regarding the reason for requesting contact.
Potential sounding assessment without a contact request
- If you carry out a potential property analysis (in other words, when you check how many investors in our contact database could be considered for the specified property) without contacting us directly, the data you have entered about your property, the time of the query and your IP address will be stored in encrypted form at the beginning of the analysis. The latter ensures that it is not possible to draw conclusions about your person (object data, encrypted usage data).
- Purpose: statistical processing of the potential real estate offer on the market as well as measuring the use of the potential analysis; safeguarding against deduplication.
- Justification: legitimate interest in use of the potential analysis to justify its maintenance.
- Storage period: see section 7

Potential sounding assessment with a contact request
- If you carry out a potential property analysis (in other words, when you check how many investors in our contact database could be considered for the specified property) you also have the possibility of contacting us directly. When submitting the contact form, specific categories of your personal data*, the result of the potential analysis as well as the time of the query will be transmitted to the relevant staff member at ADEQAT for processing (object data, contact and identification data, usage data). In addition, an encrypted form of your IP address will be stored in our system to avoid deduplication (encrypted usage data).
- Purpose: Preparation/implementation and processing of market sounding aimed at attaining a non-binding sales price for your property.
- Justification: Legitimate interest in processing the individual enquiries in a timely manner and providing a reliable answer, respectively carrying out pre-contractual measures based on your request. Avoidance of deduplication.

You have the opportunity to apply for currently advertised vacancies on our website or to send us an unsolicited application. For the application, specific categories of your data* (contact and identification data, data on personal/professional circumstances and characteristics, applicants’ photo) will be automatically processed by us.
Purpose: The purpose of the electronic processing of applicants’ data is the selection of a suitable candidate for a vacancy (application for employment/recruiting)
Justification: Legitimate interest, respectively carrying out pre-contractual measures based on your request.

[6.] Data processing requiring consent
ADEQAT processes personal data listed in section 3 for the following purposes: the specified data categories * (essentially contact and identification data) in the respective application, will only be used for the regular distribution of the newsletter. We will use the email specified by you for sending the newsletter. After registering we need your consent that you, as the owner of the email address, agree to receive the newsletter (so-called opt-in); this regulation is in effect since 25 May 2018. You may cancel the subscription anytime by using the ‘unsubscribe’ button in the newsletter.
- Purpose: Distributing the latest market trends and market information as well as analyses, product information, services and events.

[7.] Storage period for personal data
We will retain your data only for as long as we need it for the above-mentioned purposes, to provide the services you have requested or until withdrawal of your consent. Subsequently, we will lock your data in our system and only use it to meet statutory requirements (amongst other reasons, we are obliged to retain data for a certain period of time for tax or labour law reasons or in connection with the establishment, exercise or defence of legal claims). After statutory storage obligations have expired, your data will be deleted at the end of the same year in which the stated obligation expires. Anonymous data that does not allow a person to be identified will be stored indefinitely.
As set out in section 3.2, you will find all information about cookies used by ADEQAT in the Cookies Policy published on the ADEQAT website.
[9.] Data subject rights
You can assert the following rights granted to you with regard to data processing:
[9.1] Right to information
You can request confirmation as to whether, and to what extent, personal data about you is being processed.
[9.2] Right to rectify inaccurate datag
If we process incomplete or inaccurate personal data about you, you are at any time entitled to demand rectification or completion, respectively. If you are the owner of an account to our investor portal, you have the right to access, rectify or amend your own personal data at any time. In addition, you can also request termination of your user account at any time. In this case, we kindly ask you to contact us.
[9.3] Right to erasure of personal data
You may request deletion of your personal data for the following reasons: if the purpose for which the data was collected is no longer relevant, the data was processed unlawfully, the processing interferes with your legitimate data protecting interests or if the processing is based on your consent, but you have revoked your consent. It should be noted that other reasons may exist that prevent deletion of your data. These may, amongst others, include statutory retention provisions, pending proceedings, or the establishment, exercising or defence of legal claims.
[9.4] Right to restriction of processing
You have the right to restrict the processing of your data if the following applies: you contest the accuracy of the personal data, namely, for a period enabling us to verify the accuracy of the data; you consider the processing as unlawful, however you oppose the deletion of the data and instead request the restriction its usage; or, if we no longer need the data for the intended purpose, but you require the data for the establishment, exercise or defence of legal claims or if you appeal against the processing of the data.
[9.5] Right to data portability
You have the right to receive the personal data that you had provided us with in a structured, commonly used and machine-readable format, as long as we process the data based on your approval or on the fulfilment of a contract, and the processing is carried out by automated means.
[9.6] Right to object
If we invoke that processing is necessary to protect our legitimate interests, you can object against this processing, as far as you believe such interests are overridden by your interests or fundamental rights and freedoms. You can object to receiving advertising at any time without giving any reasons.
[9.7] Right to complain
If you believe that our processing of your data violates Austrian or European data privacy law and as a result your rights have been infringed upon, we ask you to contact us so that all potential issues can be clarified quickly. Of course, you also have the right to lodge a complaint with the Austrian data privacy authority or the national supervisory authority representing your habitual residence.
[9.8] Right of withdrawal
All declarations of consent given by you can at any time be revoked independent from each other. A withdrawal has the effect that we will no longer process your data for the purposes stated in the declaration of consent from this point in time. Thereby the corresponding rights, benefits, etc. can no longer be claimed.
